Patient Rights

Your Rights Matter

1. A patient has the right to access to the Patient’s Rights & Responsibilities established by this center.
2. A patient has the right to be treated with respect, consideration and dignity.
3. A patient has the right to effective communication.
4. A patient has the right to be respected based on the patient’s cultural, personal values, beliefs and preferences.
5. A patient has the right to privacy and security regarding their personal information.
6. A patient has the right to pain management.
7. A patient has the right to access, request amendment to and obtain information on disclosures of their health information, in accordance with law and regulation.
8. A patient has the right to receive care in a safe environment.
9. A patient has the right to obtain information tailored to their age, language, and ability to understand.
10. A patient has the right to access interpreting and translation services.
11. A patient has the right to receive communication support for the patient who has vision, speech, hearing, or cognitive impairments in a manner that fits the patient’s needs.
12. A patient has the right to remain free from all forms of abuse, harassment and neglect.
13. A patient has the right to be fully informed about any treatment or procedure, including the unexpected outcomes and consent to treat before they are performed.
14. A patient has the right to be fully involved regarding all aspects of their care including refusing care, treatment and resolving problems with care decisions.
15. A patient has the right to access spiritual care while at the center if desired.
16. The organization respects the patient’s right to receive care in a safe setting.

17. A patient has the right to be informed of the absence of malpractice insurance coverage.
18. If a patient is deemed incompetent by a court with proper jurisdiction according to state health and safety laws, the patient’s rights are exercised by the person appointed under state law to act on the patient’s behalf.
19. If a state court has not adjudged a patient incompetent, any legal representative designated by the patient, in accordance with the state law, may exercise the patient’s rights to the extent allowed by state law.
20. A patient has the right to see a posted written notice of Patient Rights & Responsibilities in a place or places within the ASC likely to be noticed by the patient (or their representative, if applicable) waiting for treatment. The written poster will include the name, address, and telephone number of a representative of the state agency to whom the patient can report complaints, as well as the website for the office of the Medicare Beneficiary Ombudsman.
21. Patient disclosures and records are treated confidentially, and patients are given the opportunity to approve or refuse their release, except when release is required by law.
22. Patients are provided, to the degree known, complete information concerning their diagnosis, evaluation, treatment and prognosis. When it is medically inadvisable to give such information to a patient, the information is provided to a person designated by the patient or a legally authorized person.
23. A patient has the right to change their provider if other qualified providers are available. A patient has the right to participate in decisions involving their healthcare, treatment or services, except when such participation is contraindicated for medical reasons.
24. A patient has the right to involve their family in care, treatment or services decisions to the extent permitted by the patient or surrogate decision-maker, in accordance with law and regulation.
25. The center provides the patient or surrogate decision-maker with all appropriate information about the expected outcomes of care, treatment or services to be rendered.
26. The center informs the patient or surrogate decision-maker about unanticipated outcomes of care and treatment.
27. The center provides the patient information regarding expected costs for planned services.
28. Patients are informed about procedures and given the opportunity to express concerns, complaints and grievances, including those required by state and federal regulations.
29. The patient has the right to voice grievances regarding treatment or care received.
30. The patient also has the right to voice grievances regarding treatment they felt was inadequate.
31. The patient has the right to exercise their rights without being subject to coercion, discrimination, reprisal or interruption of care that could adversely affect the patient.

Responsibilities & Grievances

Important responsibilities and grievance information for patients receiving care at Triad Ambulatory Surgical Center.

What are patient responsibilities?

Prior to receiving care, patients are informed of their responsibilities. These responsibilities require the patient to: Provide complete and accurate information to the best of his/her ability about his/her health, any medications, including over the counter products, dietary supplements, and any allergies or sensitivities.

What else is expected?

Follow the treatment plan prescribed by his/her provider. Provide a responsible adult to transport him/her home from the facility and remain with him/her for twenty-four (24) hours, if required by his/her provider.

What documents should be shared?

Inform his/her provider about any living will, medical power of attorney, or Advance Directive that could affect his/her care.

What financial and conduct responsibilities apply?

Accept personal financial responsibility for any charges not covered by his/her insurance. Be respectful of all the health care providers and staff, as well as other patients.

How are grievances handled?

The Center strives to provide high quality of care and achieve patient satisfaction. Patient grievances/complaints measure achievement of this goal and identify a need for performance improvement. All complaints received by the Center personnel shall be forwarded to the ASC Administrator or clinical director within 24 hours. The ASC Administrator/clinical director will respond to the grievance within 48 hours of receipt. For a full copy of the grievance procedure, please ask any Center personnel.

How are grievance terms defined?

Grievance/Complaint: Grievances are defined as care that the ASC provided or allegedly failed to provide. Neglect – Failure to provide goods and services necessary to avoid physical harm, mental anguish, or mental illness (42 CFR 488.301). Abuse – The willful infliction of injury, unreasonable confinement, intimidation, or punishment with resulting physical, pain, or mental anguish (42 CFR 488.301).
